ASDA’s planned expansion into Lydney can finally go ahead after the Supreme Court refused permission for Tesco to appeal against the scheme.
The court decided that Tesco Stores Limited did not raise an arguable point of law.
The court therefore refused permission for the retailer to appeal against Forest of Dean’s District Council’s planning permission, given on March 11 2014.
The original decision to grant permission, which included the expansion of the JD Norman factory complex, has previously been upheld in both the High Court and Court of Appeal.
The Supreme Court’s ruling will see the construction of a new finishing shop and offices for JD Norman, ahead of the 3,827 square metre retail store with associated car parking, several other employment units and a petrol station on land South of Cambourne Place, Lydney.
Councillor Patrick Molyneux, Leader of the Forest of Dean District Council and Cabinet Member for Governance, Regeneration and Planning Policy was delighted.
“This is great news for the town and no doubt will be welcomed by residents across the district,” he said.
“Not only does this mean additional consumer choice for the community, but the new superstore will also assist in securing local jobs at JD Norman.”
