PLANS for an Asda superstore in Cinderford have been thrown out by a High Court judge yet again.
Planning permission had been granted for the store on Steam Mills Road but the location of the store is much of the problem.
Forest of Dean District Council lost their latest judicial review – the third covering the Asda plans – requested by Midcounties Co-operative, on the basis that the council's planning committee 'failed to consider and/or to take reasonable steps to assess the true extent of the harm to the town centre' in the context previous judgements.
The second ground on which the decision to grant planning permission was quashed were due to flaws in an officers' report regarding the scheme, which contradicted a claim that S106 benefits - legal monetary agreements to benefit the community – were 'necessary' for the development to be completed.
